6.4 Full Responsibility: You are entirely legally responsible for any and all User Content you generate using our Services. This includes, but is not limited to, any claims of copyright infringement, defamation, or any other legal claims arising from your User Content.

6.5 No Monitoring or Editing: We do not monitor, edit, or review User Content before it is generated or distributed. We are not responsible for any User Content generated through our Services.

You agree not to use the Services for any unlawful purpose or in any way that violates these Terms. Prohibited uses include, but are not limited to:

7.1 Illegal Activities: Using the Services to engage in any illegal activities or to generate content that is illegal under local, state, national, or international laws.

7.2 Unauthorized Access: Attempting to gain unauthorized access to our systems, other users' accounts, or any part of the Services not intended for public access.

8.3 Local Storage: Any data retention or storage is solely the responsibility of the user and occurs locally on the user's device.

8.4 No Data Collection for Improvement: We do not collect, analyze, or use any user data or generated content to improve our Services.

9.1 Our Content: The Services, including all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, and other material contained on the Site (collectively, "Our Content"), including but not limited to the design, structure, selection, coordination, expression, and arrangement of Our Content, are owned, controlled, or licensed by or to AI Uncensored, and are protected by copyright, patent, and trademark laws, and various other intellectual property rights and unfair competition laws.

9.2 Limited License: Subject to your compliance with these Terms, AI Uncensored grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal use.

9.3 Restrictions: You may not:

• a. Copy, modify, or create derivative works based on the Services or Our Content
• b. Distribute, transmit, display, perform, or otherwise use the Services or Our Content in any way for any public or commercial purpose
• c. Reverse engineer, decompile, or disassemble the Services or Our Content
• d. Remove any copyright, trademark, or other proprietary rights notices contained in or on the Services or Our Content
• e. Use any data mining, robots, or similar data gathering and extraction methods in connection with the Services

9.4 Feedback: If you provide us with any feedback or suggestions regarding the Services ("Feedback"), you hereby assign to us all rights in such Feedback and agree that we shall have the right to use and fully exploit such Feedback and related information in any manner we deem appropriate.

By using the Services, you represent and warrant that:

11.1 As-Is Basis: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11.2 No Warranties: AI UNCENSORED EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

11.3 No Guarantee of Performance: AI UNCENSORED DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11.4 No Guarantee of Accuracy: AI UNCENSORED MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICES.

11.5 User Responsibility: YOU ACKNOWLEDGE THAT AI UNCENSORED DOES NOT CONTROL USER CONTENT AND DOES NOT GUARANTEE THE ACCURACY, INTEGRITY OR QUALITY OF SUCH CONTENT. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

12.1 Exclusion of Damages: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AI UNCENSORED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• a. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• b. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• c. ANY CONTENT OBTAINED FROM THE SERVICES
• d. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

12.2 Limitation of Liability: IN NO EVENT SHALL AI UNCENSORED'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID AI UNCENSORED IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

12.3 Basis of the Bargain: THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN AI UNCENSORED AND YOU.

13.1 User Indemnification: You agree to defend, indemnify, and hold harmless AI Uncensored and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• a. Your violation of these Terms
• b. Your use of the Services
• c. Your User Content
• d. Your violation of any rights of another party
• e. Your violation of any applicable laws, rules, or regulations

13.2 Notification: You agree to promptly notify AI Uncensored of any third-party claims, cooperate with AI Uncensored in defending such claims, and pay all fees, costs, and expenses associated with defending such claims (including, but not limited to, attorneys' fees).

14.1 Governing Law: These Terms and any disputes arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14.2 Jurisdiction: You agree to submit to the personal and exclusive jurisdiction of the courts located in California for the resolution of any disputes arising from these Terms or your use of the Services.

15.1 Informal Resolution: Before filing a claim against AI Uncensored, you agree to try to resolve the dispute informally by contacting us at support@aiuncensored.info. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or AI Uncensored may bring a formal proceeding.

15.2 Arbitration Agreement: You and AI Uncensored agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below.

15.3 Arbitration Procedures: The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in **San Francisco, California**, unless you and AI Uncensored agree otherwise.

15.4 Class Action Waiver: Any proceedings to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither you nor AI Uncensored will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.

15.5 Exceptions to Agreement to Arbitrate: Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services, or intellectual property infringement without first engaging in arbitration or the informal dispute-resolution process described above.

16.1 Termination by AI Uncensored: We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

16.2 Termination by User: You may terminate these Terms at any time by discontinuing use of the Services and closing your account.

16.3 Effect of Termination: Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services.

16.4 Survival: All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

18.1 Entire Agreement: These Terms constitute the entire agreement between you and AI Uncensored regarding the Services and supersede all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of these Terms.

18.2 No Waiver: The failure of AI Uncensored to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

19.1 By AI Uncensored: AI Uncensored may assign or delegate these Terms and/or the Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent.

19.2 By User: You may not assign or delegate any rights or obligations under the Terms or Privacy Policy without AI Uncensored's prior written consent, and any unauthorized assignment and delegation by you is void.

Nothing in these Terms is intended to or shall operate to create a partnership between the parties, or authorize either party to act as agent for the other, and neither party shall have the authority to act in the name or on behalf of or otherwise to bind the other in any way.

AI Uncensored shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
